Registration agreement

Domain Name Registration Terms and Conditions

These Terms govern domain name registration and related registrar services provided by POWER DOMS, trading as Powerdoms.

Effective ·Version 1.0

1. Acceptance and scope

These Domain Name Registration Terms and Conditions (“Terms”) form a binding registration agreement between POWER DOMS (“Registrar”, “we”, “us”, “our”) and the person or legal entity identified as the Registered Name Holder (“Registrant”, “you”, “your”) for domain names sponsored by us.

By submitting an order, registering, transferring, renewing, restoring or otherwise maintaining a domain name through us, you agree to these Terms and to all policies incorporated by reference. If you act for an organisation or another person, you represent that you have authority to bind that party.

For generic top-level domains (“gTLDs”), these Terms operate together with applicable ICANN Consensus Policies, the rules of the relevant Registry Operator, and any mandatory dispute-resolution procedure. For country-code or other non-ICANN TLDs, additional or different registry rules may apply.

Domain name registrations are time-limited contractual rights, not purchases of property. Registration is subject to the policies of the applicable Registry Operator, ICANN policies where applicable, these Terms and applicable law.

2. Definitions

“Registered Name Holder” or “Registrant” means the person or legal entity recorded as holding the registration.

“Registry Operator” means the operator of the relevant top-level domain.

“Registration Data” means information collected, generated or maintained in connection with a domain registration.

“ICANN” means the Internet Corporation for Assigned Names and Numbers.

References to an ICANN or registry policy include that policy as amended, replaced or superseded from time to time where the change is binding on the Registrar or the registration.

3. Accounts and account security

You must provide accurate, complete and current account information and keep it updated. You are responsible for safeguarding login credentials, authentication devices and recovery methods, and for activity performed through your account by you or anyone you authorise.

You must promptly notify us if you believe your account, credentials or domain names have been compromised.

We may apply reasonable security measures, including verification steps, transfer restrictions or temporary account locks, to protect an account or registration where fraud, compromise or unauthorised activity is reasonably suspected.

4. Orders, fees, payment and availability

A search result does not guarantee that a domain name is available. A registration, renewal, transfer or restore request is complete only after the relevant Registry Operator accepts the transaction and we confirm completion.

We may reject or cancel a request where the name is unavailable, reserved, restricted, prohibited, affected by a pricing or technical error, unpaid, fraudulent, unlawful, or contrary to an applicable policy.

Current prices, including registration, renewal, transfer, post-expiration renewal and redemption or restoration fees, are published on our pricing page. Unless required otherwise by applicable law, registry rules or ICANN policy, prices may change before a future transaction or renewal.

You represent that you are authorised to use the payment method supplied and that your billing information is accurate. You authorise us and our payment processors to process information reasonably necessary to complete and administer transactions.

5. Domain registration

You instruct and authorise us to submit registration and lifecycle commands to the applicable Registry Operator on your behalf.

Registration may be subject to eligibility requirements, verification, premium-name pricing, reserved-name rules, launch rules, local-presence requirements, content restrictions or other TLD-specific conditions.

You agree to comply with the policies of each applicable Registry Operator and with ICANN policies applicable to the registration. Where registry-specific terms conflict with these Terms, the mandatory registry requirement controls for that TLD to the extent of the conflict.

We may record evidence of your acceptance of these Terms and applicable policies, including a timestamp, account identifier, IP address, user-agent information and the version of the agreement accepted, subject to our Privacy Policy and applicable law.

6. Registration data accuracy

You must provide accurate and reliable Registration Data and correct or update it within seven (7) days after any change. Required information may include your name, postal address, email address, telephone number and, where applicable, an authorised contact for an organisation, together with other Registration Data required by the relevant policy or Registry Operator.

Deliberately providing inaccurate or unreliable Registration Data, deliberately failing to update it within seven (7) days of a change, or failing for more than fifteen (15) days to respond to our inquiry concerning the accuracy of Registration Data is a material breach of this agreement and may result in suspension or cancellation of the affected registration.

We may verify or re-verify Registration Data where required by ICANN policy, registry rules, applicable law or reasonable anti-fraud and account-security procedures.

If we receive a credible report that Registration Data is inaccurate, we may investigate and request correction or supporting information.

7. Registration data and privacy

We process Registration Data for purposes connected with providing registrar services, including registration and lifecycle management, customer support, security, fraud prevention, billing, regulatory and contractual compliance, dispute handling, registry communication, data escrow and registration data directory services where required.

Registration Data may be provided to the relevant Registry Operator, ICANN-approved data escrow providers, infrastructure and service providers, dispute-resolution providers, competent authorities where legally required, and other recipients described in our Privacy Policy.

The categories of data collected, whether they are mandatory or optional, applicable retention rules and your available access or correction rights are described in our Privacy Policy.

By entering into this agreement, you consent to the processing described here where consent is required or relied upon. Where applicable law permits or requires processing on another legal basis, that processing may instead rely on that legal basis as explained in our Privacy Policy.

If you provide Personal Data concerning another individual, you represent that you are authorised to provide it, that the individual has received any notice required by applicable law, and that any required legal basis or consent for the processing exists.

We take reasonable technical and organisational precautions to protect Personal Data against loss, misuse, unauthorised access or disclosure, alteration and destruction.

We will not process Registration Data incompatibly with the purposes and limitations described in the applicable privacy notice, except where otherwise permitted or required by law.

8. Registrant representations and responsibilities

By registering, renewing, transferring or maintaining a domain name, you represent and agree that, to the best of your knowledge and belief, neither the registration nor its direct or indirect use infringes the legal rights of any third party.

You will not knowingly register or use the domain name for an unlawful purpose or in violation of applicable laws or regulations.

You are responsible for determining whether your registration and use of the domain name are lawful and do not violate third-party rights.

You will comply with these Terms and all applicable ICANN and Registry Operator policies.

You will keep your account and Registration Data current and respond to registrar inquiries as required.

You are responsible for the configuration and use of the domain name, including services operated through it.

9. Use of a domain by another person

If you license or otherwise permit a third party to use a domain name while you remain the Registered Name Holder, you remain responsible for providing your own accurate Registration Data and for maintaining contact information sufficient to resolve problems concerning the domain.

You accept liability for harm caused by wrongful use of the domain unless, within seven (7) days after receiving reasonable evidence of actionable harm, you disclose the identity and current contact information of the licensee to the party providing that evidence, to the extent permitted by applicable law.

10. Nameservers, DNS and DNSSEC

You are responsible for supplying valid nameserver and DNS configuration information where required.

DNS changes may take time to propagate and third-party DNS or hosting services may operate independently from us.

Where we offer DNSSEC management for a TLD, DNSSEC data is accepted and transmitted subject to registry capabilities and applicable technical standards.

Incorrect DNSSEC configuration can make a domain unreachable. You are responsible for ensuring that DNSSEC information supplied by you or your DNS provider is correct.

11. Renewal, expiration and restoration

Our renewal policy explains renewal reminders, optional automatic renewal and the expected deletion schedule. For the standard gTLDs covered by our published policy, the expected deletion point is 35 days after expiration, subject to the exceptions and registry lifecycle rules described there.

You are responsible for maintaining current contact and payment information. A renewal is not guaranteed until it is accepted by the Registry Operator and confirmed by us.

For gTLD registrations subject to ICANN’s Expired Registration Recovery Policy, we send the required expiration reminder notices to the applicable registrant contact, including notices approximately one month and approximately one week before expiration.

If the registration is not renewed or deleted, an additional notice is sent within the period required by the applicable policy after expiration. We may send additional reminders.

After expiration, a domain may stop resolving, be placed on hold, enter an auto-renew grace period, be deleted, enter a Redemption Grace Period, or become subject to other registry lifecycle states. Timing varies by TLD and Registry Operator.

You should not rely on a grace period as a substitute for timely renewal.

Where a Registry Operator offers a Redemption Grace Period or equivalent recovery mechanism, restoration may be possible before final deletion. Restore fees, together with any applicable renewal or registry charges, are published on our pricing page.

12. Domain transfers

Transfers of gTLD registrations between registrars are handled under the applicable ICANN Transfer Policy and registry requirements.

You may be required to unlock the domain, obtain or provide authorisation credentials, complete identity or account verification, and satisfy any applicable transfer restrictions.

A transfer may be denied or delayed where permitted by ICANN policy, registry rules or applicable law, including certain fraud, dispute, payment, lock or recently completed registration or transfer circumstances.

Where a transfer lock is optional, we apply it only as permitted by applicable policy and the choices made by the Registrant.

We provide access to transfer authorisation information and transfer-management functions through the services made available to your account or through our support process where appropriate.

13. Cancellation, deletion and refunds

You may request cancellation or deletion of a registration through the available account or support process, subject to identity verification, registry restrictions, pending disputes, lifecycle status and applicable law.

Deletion may be irreversible and may allow another party to register the name after applicable registry lifecycle periods.

Domain registration, renewal, transfer and restore transactions are often submitted immediately to third-party registries and may therefore be non-refundable once completed, except where required by law or stated in our refund rules.

An order cancelled before submission to the registry is refunded. After a registration, renewal, transfer or restoration has been successfully processed, it is normally non-refundable, except where required by applicable law or where we have made an error. If an order fails, we return the unspent amount. Mandatory consumer rights remain unaffected.

14. DNS abuse and illegal activity

Reports concerning domain names sponsored by us may be submitted through our published abuse-reporting channels. Our Abuse Handling Procedure explains how reports are received, acknowledged, assessed, investigated, tracked and resolved.

For purposes of ICANN registrar obligations, DNS Abuse includes malware, botnets, phishing, pharming, and spam when spam is used as a delivery mechanism for those forms of DNS Abuse.

We take reasonable and prompt steps to investigate abuse reports.

Where we have actionable evidence that a gTLD domain sponsored by us is being used for DNS Abuse, we may take appropriate mitigation action reasonably necessary to stop or disrupt the abuse, taking account of the circumstances, severity and risk of collateral damage.

Mitigation may include contacting the Registrant or relevant service provider, requiring remediation, restricting services, applying an appropriate hold, suspending resolution, locking the registration, or taking another proportionate action permitted by contract, policy or law.

Urgent action may be taken where reasonably necessary to address a serious threat to users, DNS security or stability, or to comply with a lawful order.

15. Domain-name disputes and rights-protection procedures

The ICANN Uniform Domain Name Dispute Resolution Policy (“UDRP”) is incorporated into this agreement for gTLD registrations to which it applies.

You also agree to any applicable Uniform Rapid Suspension (“URS”) procedure and any TLD-specific dispute-resolution procedure required by the relevant Registry Operator.

We may lock, suspend, cancel, transfer or otherwise modify a registration to implement a binding decision, court order, arbitration outcome, registry requirement or other action required under an applicable dispute policy or law.

For disputes concerning or arising from use of the domain, you submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts of your domicile and the courts where the Registrar is located.

16. Suspension, cancellation and transfer of registrations

You agree that a registration may be suspended, cancelled, transferred, locked, placed on hold or otherwise modified when required or permitted by an applicable ICANN Specification or Policy, a registry procedure consistent with those policies, applicable law, a court or administrative order, or these Terms.

In particular, action may be taken to correct a mistake by us or the Registry Operator in registering the name, to resolve a dispute concerning the domain, to address a material breach of this agreement, to respond to actionable DNS Abuse, to protect account security, or to comply with lawful requirements.

Where permitted and appropriate, we may notify you and provide an opportunity to remedy an issue. Immediate action may be taken where law, urgent harm, security considerations or an applicable policy requires it.

17. Registry Operators and third-party services

Domain registration depends on services operated by Registry Operators, ICANN, DNS providers, payment processors and other third parties outside our direct control.

Registry policies, maintenance events, service outages, policy changes and technical failures may affect a domain transaction or availability.

Links to third-party websites or services are provided for convenience. Unless expressly stated otherwise, we do not control and are not responsible for third-party content, policies or services.

18. Disclaimer of warranties and limitation of liability

To the maximum extent permitted by applicable law, registrar services are provided on an “as available” basis.

We do not guarantee that every requested domain will be registered, renewed, transferred or restored, or that the website, account system, registry connection or DNS-related service will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, POWER DOMS, its directors, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, goodwill, business opportunity or data, arising from use of or inability to use the services, registry or third-party actions, unauthorised account access, or loss of a domain name.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory consumer right applicable to you.

19. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the applicable Registry Operator and its directors, officers, employees and agents from claims, damages, liabilities, costs and reasonable legal expenses arising out of or related to your domain name registration.

You also agree, to the extent permitted by law, to indemnify POWER DOMS and its directors, employees and agents against third-party claims arising from your unlawful use of the services, your material breach of these Terms, or your infringement of third-party rights, except to the extent caused by our own unlawful conduct.

20. Account suspension and termination

We may suspend or terminate access to an account where reasonably necessary because of material breach, fraud, security risk, non-payment, unlawful conduct, abuse, sanctions or legal restrictions, or where continued service would cause us to breach an ICANN or registry obligation.

Termination of an account does not automatically cancel domain registrations unless the registration is separately cancelled, transferred, expired or otherwise acted upon in accordance with applicable policy.

We may require you to resolve outstanding obligations or complete verification before certain account actions are permitted.

21. Governing law and jurisdiction

These Terms are governed by United Kingdom, without prejudice to mandatory consumer-protection, data-protection or other rights that apply regardless of a contractual choice of law.

For disputes concerning or arising from the use of a Registered Name, you submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of your domicile and (2) where the Registrar is located, currently London.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect to the fullest extent permitted by law.

A failure to enforce a provision is not a waiver of that provision or any other right.

22. Changes to these Terms

We may update these Terms to reflect changes in law, ICANN policy, Registry Operator requirements, our services, security needs or business processes.

Where a change materially affects existing registrations, we provide notice in the manner and within the period required by applicable law, ICANN policy or our contractual obligations.

The version applicable to a transaction is the version presented or incorporated at the time of that transaction, subject to later binding ICANN, registry or legal requirements.

We recommend that you retain a copy of the Terms applicable to your registration.

23. Registrar information, support and notices

POWER DOMS, trading as Powerdoms, is the registrar providing the services described in this agreement.

Current company, registrar and contact information is published on our contact page.

Customer-support requests should be submitted through our published support channels. Abuse reports should use the dedicated abuse-reporting process.
